Photo credit: Daniel Foster \/Flickr[\/caption]\n<p>Hilcorp Energy, a Texas-based oil and gas company, is pushing&nbsp;<a href=\"http:\/\/thinkprogress.org\/climate\/2014\/03\/31\/3420837\/drilling-company-forced-pooling\/\">legal action<\/a>&nbsp;in Pennsylvania to be able to drill underneath the property of landowners that have refused to sign a lease if enough of their neighbors have already signed, a practice known as &#8220;forced pooling.&#8221; The &#8220;<a href=\"http:\/\/www.yorkdispatch.com\/business\/ci_20467702\/ohio-state-drilling-laws-trump-owner-objections\" target=\"_blank\">unused and outdated<\/a>&#8221; law, which is &#8220;pitting neighbor against neighbor&#8221;&nbsp;<a href=\"http:\/\/bigstory.ap.org\/article\/neighbors-bicker-pa-over-forced-gas-drilling\/\" target=\"_blank\">as reported by<\/a>&nbsp;the Associated Press, would &#8220;shred private property rights&#8221; according to the&nbsp;<em>Pittsburgh Tribune Review<\/em>, the only of the three highest circulating papers in Pennsylvania to cover the story. The other two,&nbsp;<em>The Philadelphia Inquirer&nbsp;<\/em>and the&nbsp;<em>Pittsburgh Post<\/em><em>-Gazette<\/em>, have completely overlooked the issue which has received&nbsp;<a href=\"http:\/\/www.cbsnews.com\/news\/fracking-for-all-pa-law-pits-neighbor-against-neighbor-in-drilling-fight\/\" target=\"_blank\">national<\/a>&nbsp;attention.<\/p>\n<p>The &#8220;forced pooling&#8221; law would force landowners to allow the use of fracking to extract natural gas reserves underneath their property without their consent,&nbsp;<a href=\"http:\/\/www.nytimes.com\/2014\/03\/31\/us\/law-may-force-drilling-on-balking-landowners.html?_r=1\" target=\"_blank\">creating<\/a>&nbsp;concerns about the <a href=\"http:\/\/ecowatch.com\/2013\/11\/13\/fracking-american-dream-drilling-decreases-property-value\/\" target=\"_blank\">impact on property values<\/a> and the threat of water pollution. A leaked document from the U.S. Environmental Protection Agency (EPA)&nbsp;<a href=\"http:\/\/www.washingtonpost.com\/politics\/epa-official-links-fracking-and-drinking-water-issues-in-dimock-pa\/2013\/07\/29\/7d8b34b2-f8a1-11e2-afc1-c850c6ee5af8_story.html\" target=\"_blank\">stated<\/a>&nbsp;that natural gas extraction has caused methane to leak into domestic water wells, causing &#8220;significant damage&#8221; to the drinking water supply of the town.<\/p>\n<p>Pennsylvania isn&#8217;t the only state dealing with the &#8220;forced pooling&#8221; issue. Energy companies have been&nbsp;<a href=\"http:\/\/investigations.nbcnews.com\/_news\/2012\/10\/02\/14183177-energy-firm-uses-land-grabs-to-secure-fracking-rights-from-reluctant-landowners\" target=\"_blank\">exploiting<\/a>&nbsp;similar laws in&nbsp;<a href=\"http:\/\/projects.propublica.org\/tables\/forced-pooling\" target=\"_blank\">many states<\/a>&nbsp;including in Illinois and Ohio to the&nbsp;<a href=\"http:\/\/stateimpact.npr.org\/pennsylvania\/2012\/04\/25\/landowners-angry-with-ohios-forced-pooling-laws\/\" target=\"_blank\">outrage<\/a>&nbsp;of unsuspecting landowners. In Ohio, citizens are &#8220;furious&#8221; about the ruling that one citizen&nbsp;<a href=\"http:\/\/www.yorkdispatch.com\/business\/ci_20467702\/ohio-state-drilling-laws-trump-owner-objections\" target=\"_blank\">fears<\/a>&nbsp;will &#8220;make him legally responsible for spills and other damage&#8221; according to the Associated Press.&nbsp;<a href=\"http:\/\/investigations.nbcnews.com\/_news\/2012\/10\/02\/14183177-energy-firm-uses-land-grabs-to-secure-fracking-rights-from-reluctant-landowners\" target=\"_blank\">Some<\/a>&nbsp;residents&nbsp;have &#8220;resigned to losing future income,&#8221; while dozens of others are pushing forward lawsuits in an attempt to stop the forcible drilling.&nbsp;<\/p>\n<p>There is a similar sentiment in Pennsylvania even among those who support natural gas drilling and fracking. For example, Pennsylvania&#8217;s Gov. Corbett (R-PA)&mdash;a strong proponent of natural gas extraction in Pennsylvania&mdash;opposes the law,&nbsp;<a href=\"http:\/\/old.post-gazette.com\/pg\/11117\/1142127-503-0.stm?cmpid=news.xml\" target=\"_blank\">likening it<\/a>&nbsp;to &#8220;private <a href=\"http:\/\/ecowatch.com\/2013\/08\/02\/eminent-domain-used-to-push-big-oils-agenda\/\" target=\"_blank\">eminent domain<\/a>.&#8221; And Marcellus Drilling News, a pro-fracking news site, has expressed&nbsp;<a href=\"http:\/\/marcellusdrilling.com\/2013\/10\/hilcorp-uses-pa-forced-pooling-law-against-lawrence-cty-landowner\/\" target=\"_blank\">disapproval of<\/a>&nbsp;Hilcorp&#8217;s use of the law, calling it &#8220;the low road.&#8221;&nbsp;<\/p>\n<p>Hilcorp first requested to use the 1961 Pennsylvania law in&nbsp;<a href=\"https:\/\/stateimpact.npr.org\/pennsylvania\/2014\/03\/31\/dep-postpones-hearings-on-forced-pooling-request-in-western-pa\/\" target=\"_blank\">July<\/a>, when property owner Bob Svetlak refused to give up the land he has&nbsp;<a href=\"http:\/\/triblive.com\/business\/headlines\/4828098-74\/hilcorp-pooling-gas#axzz2xXk5nI4f\" target=\"_blank\">lived on<\/a>&nbsp;since 1949, and moved forward with a&nbsp;<a href=\"http:\/\/marcellusdrilling.com\/2013\/10\/hilcorp-uses-pa-forced-pooling-law-against-lawrence-cty-landowner\/\" target=\"_blank\">legal action<\/a>&nbsp;in October. The case bounced around&nbsp;<a href=\"http:\/\/stateimpact.npr.org\/pennsylvania\/2013\/11\/21\/environmental-court-says-dep-has-to-consider-forced-pooling-request\/\" target=\"_blank\">different ruling bodies<\/a>&nbsp;in the state with a final hearing eventually scheduled for late March 2014 &nbsp;that was&nbsp;<a href=\"https:\/\/stateimpact.npr.org\/pennsylvania\/2014\/03\/31\/dep-postpones-hearings-on-forced-pooling-request-in-western-pa\/\" target=\"_blank\">subsequently postponed<\/a>&nbsp;until early May due to the controversy surrounding the issue.<\/p>\n<p>Since Hilcorp&#8217;s first request in July, the&nbsp;<em>Pittsburgh Tribune Review<\/em>&nbsp;has published an editorial against the law, saying it &#8220;shreds private property rights&#8221; and is &#8220;patently unconstitutional.&#8221; But the two other top Pennsylvania newspapers&mdash;<em>Pittsburgh Post-Gazette<\/em>&nbsp;and&nbsp;<em>The Philadelphia Inquirer<\/em>&mdash;have remained silent on the issue over the same period (which is based on a Nexis search of hydraulic fracturing or frack! or Hilcorp from July 1, 2013, to April 13, 2014):<\/p>\n<p><a href=\"http:\/\/ecowatch.com\/2014\/04\/14\/pennsylvania-forced-pooling-fracking-law\/papapers\/\" rel=\"attachment wp-att-330535\"><img loading=\"lazy\" decoding=\"async\" alt=\"papapers\" src=\"http:\/\/files.cdn.ecowatch.com\/wp-content\/uploads\/2014\/04\/papapers.png\" width=\"460\" height=\"342\"><\/a>&nbsp;<\/p>\n<p>While never addressing the &#8220;forced drilling&#8221; issue, the&nbsp;<em>Pittsburgh Post-Gazette<\/em>, which&nbsp;<a href=\"http:\/\/www.post-gazette.com\/opinion\/2014\/01\/28\/Winter-of-our-content\/stories\/201401280007\" target=\"_blank\">publicly<\/a>&nbsp;&#8220;supports a well-regulated gas drilling industry,&#8221; has been calling for fracking underneath the state&#8217;s public lands&mdash;an issue that also has many citizens&nbsp;<a href=\"http:\/\/www.credomobilize.com\/petitions\/stop-the-fracking-of-our-allegheny-county-regional-parks\" target=\"_blank\">concerned<\/a>&mdash;<a href=\"http:\/\/www.post-gazette.com\/opinion\/2014\/03\/24\/Prudent-drilling\/stories\/201403210002\" target=\"_blank\">praising<\/a>&nbsp;a deal to drill underneath a county park and&nbsp;<a href=\"http:\/\/www.post-gazette.com\/opinion\/editorials\/2013\/09\/16\/Delay-tactic-The-county-doesn-t-need-a-park-drilling-moratorium\/stories\/201309160192\" target=\"_blank\">decrying<\/a>&nbsp;a proposed moratorium on drilling underneath state parks.
